Program Summary Immigration and Customs Enforcement (ICE) targets illegal immigration by focusing on U.S. employers. ICE uses the I-9 Form and hiring records to target employers that do not comply with employment eligibility verification laws. Even errors unrelated to immigration or foreign workers can result in $110 to $1,100 for a minor violation.
With increased scrutiny on U.S. employers, businesses should keep accurate records for employees, even if they do not employ foreign workers. Back by popular demand, the seminar, “Form I-9 & E-Verify: What You Need to Know 2010,” led by Attorney John Wilson and the GoffWilson I-9 Team, focuses on:
- Completing the I-9 Form properly and completely
- The most common errors that can result in ICE scrutiny and fines
- Review of acceptable verification documents
- The most up-to-date legal requirements employers must abide by for the I-9 Form and E-Verify
Participants are given hands-on exercises to put education into practice. Participants will receive the 2010 version of the GoffWilson workbook and reference guide. This take-home training manual contains exercises completed during training, examples of correctly completed I-9 Forms, copies of the accompanying identification documents and frequently asked questions for future reference.
Special guest, Attorney Jim Reidy, of Sheehan, Phinney, Bass + Green, P.A., will present a Labor Law Legal Update for participants.
Other imprtant information that will be covered and reviewed:
- As of April 3, 2009, employers were required to use the 02/02/2009 version of the I-9 form. In August 2009, the 08/07/2009 version of the I-9 form was released. Employers are now only permitted to use the 02/02/2009 or 08/07/2009 versions of the I-9 form.
- Effective April 3, 2009, all supporting documents used to complete the I-9 form must be unexpired.
- Most new and some existing federal contractors must enroll in and use E-Verify if the contract contains a clause mandating the use of E-Verify. The federal government started awarding contracts containing the clause on September 8, 2009.
- Under the Obama administration, the worksite enforcement policy has changed. These policy changes shifted liability away from the undocumented workers and to the employer. Immigration and Customs Enforcement now has the financial resources to investigate and develop cases against U.S. employers for crimes such as money laundering, tax evasion, wage and hour violations, and RICO crimes.
